Public Hearing

PZC2007-33 Subdivision Regulation Change to allow for an extension of 6 months or until new subdivision regulations are adopted (whichever is sooner) of the existing temporary, limited moratorium on subdivision applications and approvals to allow the Commission to continue study, develop and edit the draft open space subdivision regulations (a variation of Cluster Development pursuant to CGS 8-25 ( c ) with the possibility of exempting from the moratorium subdivisions and re-subdivision of 3 lots or less AND consisting of 15 acres or less overall. (Public Hearing 05/04/2010)

M. Ellis called the meeting to order at 7:30.  

M. Ellis said the commission has been working with the attorney, surveyor and engineer.  They came up with draft regulations which were finalized at last Tuesday’s workshop.  The commission sent the finalized draft to the engineer, Teri Haun, to work through with 2 mock plans.  They hope to get them back in 30 days and the Public Hearing will follow.

Attorney Samuel Schrager was present.  He said he was before the commission last October. He said his client owns a parcel that exceeds the 15 acres and he would like to create 3 lots but he is not eligible for the exemption.  He said he is requesting that the Commission modify the wording in the moratorium to change the degree of exemption.  He said they have waited in good faith since last October, expecting the Moratorium to be lifted in May and now the Commission is requesting an exemption.  The letter from Attorney Schrager was entered into the record.    

E. Standish motioned to close the Public Hearing.  J. Poole seconded the motion.  All in favor.  Motion carried.

Old Business

PZC2010-3 ~Application for Modification to Special Permit ~Final Site Development Plan to add ~in the future a 25’X35” 3 sided pole building at 49 Hancock Road (Map 38 Lot 20 Zone R80)Owner/Applicant: Town of Willington (Received March 16, 2010 Decision by ~May 18, 2010)

Selectman Christina Mailhos said she is expecting a letter from DEP very shortly.  She said she sent a letter to the attorney to see if the town will be covered by having the proposed signage at the building.  This application was tabled until the May 18, 2010 meeting.

PZC2010-15 Application for Modification of Special Permit & Final Site Development Plan with ~~~the addition of a recreational storage shed at 60 Old Farms Road (Map 17 Lot 1 Zone R-DER) ~~~~Owner: Town of Willington Applicant: Matthew Rains (Received April 20, 2010 Public Hearing ~~~by June 15, 2010 Decision within 65 days after close of P.H.)

Modified drawings were presented to the commission.  S. Yorgensen said the plan is the original site development and when the as-built is completed, it will have what is actually on site.  

M. Ellis motioned to approve the modification of the special permit and final site development plan with the condition that the as-built be updated upon completion.  T. Murphy seconded the motion.  All in favor.

Standish motioned to approve the extension of the moratorium for 6 months (Nov. 30, 2010) or until the open space subdivision regulations are completed (whichever is sooner) and to exempt from the moratorium subdivisions and re-subdivisions of 3 lots or less AND consisting of 15 acres or less overall.  W. Parsell seconded the motion.  All in favor.

PZC2010-13 Request for review and approval pursuant to CGS 8-24 for a water main extension along Old Farms Road from 60 Old Farms Road & Center School to 12 Old Farms Road ~Owner/Applicant: Town of Willington (Report by May 18, 2010 or assumption of approval)

Matt Brown of Anchor Engineering was present.  A discussion was held on the date of the document.  J. Poole asked if it was Nov. 19, 2009 and Mr. Brown said he believes so.  J. Poole asked that the documents be dated in the future.  He also wanted it noted that at the last meeting Mr. Zessin said the Commission received the documents on April 8th but they did not receive them until April 20th.  A discussion was held on the path of the water main.  Mr. Brown said it will run 1800 feet in the road and 1500 feet out of the roadway.  He said the route was selected a while ago and showed the changes on the map.  He also showed the road crossings and a discussion was held.  

S. Yorgensen asked if the crossing was the only point in the center of the road and Mr. Brown said no, between the Town Hall and school, it is all within the road.  S. Yorgensen said it seems as if it would be better if done outside of the pavement.  Mr. Brown said the challenge is the road is not centered within the town’s Right of Way and showed this on the plans.  He said by doing it this way, they will not impact anyone’s driveway.  

A discussion was held on future water drainage projects.  A discussion was held on whether or not a homeowner would have to connect if they live in the zone.  Selectman Mailhos said the former Selectman contacted the state and if it is a town owned water main within the town’s Right of Way, they can decide to allow for connection or not.  J. Sullivan asked about documentation stating this and Selectman Mailhos said she did not have documentation.  

A discussion was held on the capacity of the water main.  Mr. Brown said it is a private main so the DEP would never have approved it for multiple connections.  It has only been approved for the town office building, the school and the fire house.  J. Poole said it does not show the fire house on the plans.  Selectman Mailhos said it is not in the CIP and they do not have funding nor have they asked yet.  

J. Poole asked about changing the path of the main and Mr. Brown said it is about the same distance and showed this on the plans.  J. Poole asked if they’ve explored the costs of both alternatives and Mr. Brown said they have not but installing the water main within pavement will be at a much higher cost.  A discussion was held on pumps.

A discussion was held on fragment wells.  Selectman Mailhos said they are exploring fragment wells.  J. Sullivan asked what happens if they find water.  Selectman Mailhos said they would have to find out if STEAP money can be used a different way.  M. Ellis asked why this was not done before the plan was in place.  Selectman Mailhos said the plan was in place months ago and said they may have a lot of options in the future.  

A discussion was held on the HUD Grant and Selectman Mailhos said once the town connects with this water main, they will have to start paying for a portion of the water used.
 
A. Marco motioned to approve pursuant to CGS 8-24 the extension of the water main from 60 Old Farms Road up to 12 Old Farms Rd.  W. Parsell seconded the motion. All in favor.  

New Business
PZC2010-14 Request for review and approval pursuant to CGS 8-24 for construction of new water service from the water main on Old Farms Road to Center School building (12 Old Farms Road) Owner/Applicant: Town of Willington (Report by May 18, 2010 or assumption of approval)

M. Ellis said conceptually they just approved the water main and it would make sense to connect to the school.  

A. Marco motioned to approve pursuant to CGS 8-24 the connection from the water main on Old Farms Road to Center School.  T. Murphy seconded the motion.  J. Poole abstained.  All others in favor.

PZC2010-16 ~Application for Special Permit to open restaurant at 11 Phelps Way (Map 30 Lot 14 Zone DC) Owner: C & S Willington LP Applicant: Luciano Conforto (Received May 4, 2010 Public Hearing by June 15, 2010 Decision within 65 days after close of P.H.)

M. Ellis motioned to set the Public Hearing for June 1, 2010.  E. Standish seconded the motion.  All in favor.

Subdivision Regulations

M. Ellis said the Draft Subdivision Regulations are with Teri Haun and she is doing a work through.
